The Transgender Health and Wellness Center (“TH&WC,” “we,” “us,” or “our”) is  committed to protecting the privacy and confidentiality of our patients, clients, and  community members. This SMS Privacy Policy explains how we collect, use, protect, and  manage information in connection with our text messaging (SMS) communications.  

  1. Purpose of SMS Communications 

The Transgender Health and Wellness Center uses SMS (text messaging) to communicate  with patients and clients for purposes including, but not limited to:  

  • Appointment reminders and confirmations  
  • Scheduling or rescheduling requests
  • Care coordination and follow-up messages
  • Program updates or service-related notifications
  • Event, group and resource updates and notifications 
  • Administrative and billing-related communications
  • Informational or educational messages related to services you have requested

We do not use SMS messaging for marketing or promotional purposes without explicit  consent. 

  1. Consent to Receive SMS Messages 

By providing your mobile phone number and opting in, you expressly consent to receive  SMS messages from the Transgender Health and Wellness Center.  

Consent may be obtained through:  

  • Written consent forms  
  • Electronic intake forms
  • Patient portals
  • Verbal consent documented in our records 
  • Keyword opt-in (where applicable)

Consent is not a condition of receiving care or services

  1. Message Frequency 

Message frequency varies based on your engagement with our services but typically  includes:  

  • Appointment-related messages as needed  
  • Occasional service or care coordination messages
  • Updates about events and resources
  1. Opt-Out Instructions 

You may opt out of receiving SMS messages at any time by replying:

After opting out, you will no longer receive SMS messages from us unless you re-enroll. You  may receive a final confirmation message acknowledging your opt-out. You may also reach  out to our staff and make the request verbally or in writing.

  1. Privacy and Data Use 

We respect your privacy and take reasonable steps to protect your personal information.  We do not sell, rent, lease, or share your mobile number or SMS data with third  parties for marketing purposes.  

  • Information obtained through SMS communications is used only to support patient  care, services, and operations.
  • SMS content may include limited protected health information (PHI) when necessary and appropriate.
  • All data is handled in accordance with applicable privacy laws, including HIPAA where applicable. 
 
  1. Data Sharing and Carriers
  • Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
  • Message delivery is subject to transmission by mobile carriers and network availability.
  • Carriers are not responsible for delayed or undelivered messages.
  1. Security Considerations 

While we take appropriate measures to safeguard your information, SMS messaging is not  a fully secure or encrypted communication method. By opting in, you acknowledge and  accept this risk.  

If you prefer not to receive sensitive information via text, please notify us and we will  communicate through alternative methods.  

  1. Message and Data Rates 

Message and data rates may apply, depending on your mobile carrier and plan. You are  responsible for any fees charged by your carrier related to SMS messaging.  

  1. Eligibility 

You must be at least 18 years old or have the consent of a parent or legal guardian to  participate in SMS communications with the Transgender Health and Wellness Center. For eligibility for communications under Marsha P Johnson Youth Drop-In Center, please see  MPJ Addendum below. 

  1. Changes to This Policy 

We may update this SMS Privacy Policy and SMS Terms and Conditions from time to time.  Updates will be posted on our website or made available upon request. Continued  participation in SMS communications after changes constitutes acceptance of the revised  policy.

  1. Marsha P. Johnson Youth Drop-In Center (MPJ) Addendum 

Youth ages 13-17 may elect to receive MPJ-specific messages through the Remind service.  Messaging via Remind is governed by Remind’s COPPA-compliant framework. Access to  Remind for MPJ communications is limited and administered only by vetted MPJ personnel  and is separate from all other TH&WC communication channels and does not include  marketing, fundraising or general TH&WC communications. 

Compliance Statement (10DLC / A2P) 

This SMS Privacy Policy and SMS Terms & Conditions are designed to meet A2P 10DLC  requirements, including consent, opt-out mechanisms, message disclosure, data  protection, and non-sharing of consumer mobile data, consistent with carrier and  aggregator standards such as those required by 0wire Communications, LLC.
